The FlightChic Take: Not an Airline. Not a Private Jet Broker. Just What Is JSX?
JSX has cleverly walked a fine line, operating under a 14 CFR 135 certificate for on-demand operations. That regulation allows limited scheduled or Scheduled (Commuter) operations to serve with aircraft carrying no more than 30 passengers. JSX takes advantage of a loophole in the FAA’s regulations. But that loophole may close soon.
While JSX has partnered with United Airlines and JetBlue, JSX has annoyed its Texan neighbor, American Airlines (AAL). It is also facing backlash from pilot unions. Both have appealed to the FAA to reign in the growth of this type of charter service.
AAL and unions argue that JSX has an unfair competitive advantage and may pose a safety risk. This is because JSX charter flights don’t have to meet the same training requirements for first officers as airlines. They are not beholden to mandatory retirement of pilots at age 65. Pilots of JSX aren’t required to have the same minimum rest periods as regulations require for airline pilots.
JSX can offer convenient transfer by flying through the same airport FBOs (Fixed Based Operations) as private jet operators. The Transportation Security Administration doesn’t screen passengers on those flights.
FAA Commits to Rulemaking
This week, in a notable setback for JSX, the FAA has decided to look into it. As Reuters reports, “The FAA said on Thursday ‘this rapid growth poses an increased risk to safety if left unchecked’ and said it will ‘begin a rulemaking to address this safety risk.'”
Still, JSX is a very convenient flight service. Scheduled charter operations open flight access to smaller airports, remote communities, and hard-to-reach destinations that airlines cannot serve effectively. This will be a development worth tracking.
